The Department of Labor & Industries (L&I) is changing employment rules that determine which salaried employees in Washington are required by law to receive overtime pay, minimum wage and paid sick leave. These changes will affect Executive, Administrative, and Professional (EAP) workers across all industries in Washington State.

Changes to these rules will mean some employers will have to provide overtime, minimum wage, and paid sick leave to employees who previously were considered exempt. These employees will have new rights and protections under the Minimum Wage Act.

In April 2018, L&I started meeting with representatives from business and labor organizations to exchange ideas on key issues that will be addressed in the process of changing the employment rules.

Opportunity to review pre-draft rules We have used input from stakeholders to create pre-draft rules which will be released by the end of Friday, October 5th. At that time, you will be able to find them here. The deadline for providing feedback on the pre-draft version will be Friday, October 26th.

Feedback sessions in October Employers and employees are encouraged to attend one of L&I’s feedback sessions below. The first part of the meeting will provide a historical overview of the EAP rules, the rulemaking timeline, and an overview of the proposed draft edits to the rules.

The second part will give the public an opportunity to offer comments on both the rulemaking effort and the pre-draft version of the rule language. L&I staff will be available to answer questions and engage attendees in a discussion about the pre-draft rules.
