Since July of 2007, it is a felony in the State of Washington if any person arrested for DUI has 4 or more prior offenses within ten years, or if the person arrested has ever previously been convicted of vehicular homicide or vehicular assault while under the influence of alcohol and/or drugs.

Since the felony DUI law was enacted, the Washington State Patrol has charged 82 impaired drivers for felony DUI. 17 of the 82 have been charged in King County alone.
